Lawyer: Over 150 Minneapolis officers seeking disability

More than 150 Minneapolis police officers are filing work-related disability claims after the death of George Floyd and ensuing unrest, with about three-quarters citing post-traumatic stress disorder as the reason for their planned departures, according to an attorney representing the officers.

Their duty disability claims, which will take months to process, come as the city is seeing an increase in violent crime and while city leaders push a proposal to replace the Minneapolis Police Department with a new agency that they say would have a more holistic approach.

While Floyd’s death in May and the unrest that followed are not the direct cause of many of the disability requests, attorney Ron Meuser said, those events and what Meuser called a lack of support from city leadership were a breaking point for many who had been struggling with PTSD from years on the job. Duty disability means the officer was disabled while engaged in inherently dangerous acts specific to the job.

“Following the George Floyd incident, unfortunately it became too much and as a result they were unable to, and are unable to, continue on and move forward,” Meuser said. “They feel totally and utterly abandoned.”

He said many officers he represents were at a precinct that police abandoned  as people were breaking in during the unrest. Some officers feared they wouldn’t make it home, he said, and wrote final notes to loved ones. People in the crowd ultimately set fire to the building.

Mayor Jacob Frey issued a statement saying that COVID-19 and unrest following Floyd’s death tested the community and officers in profound ways. He said cities need resources to reflect the realities on the ground.

“In the meantime, I am committed to supporting those officers committed to carrying out their oath to serve and protect the people of Minneapolis during a challenging time for our city,” he said.

Meuser said in recent weeks, 150 officers have retained his office for help in filing for duty disability benefits through the state’s Public Employment Retirement Association, or PERA. So far, 75 of them have already left the job, he said.

Police spokesman John Elder questioned Meuser’s figure of 150, though he does expect an increase in departures. The department currently has about 850 officers and will adjust staffing to ensure it can do its job, he said.

The city said it has received 17 PTSD workers compensation claims in the last month, but when it comes to PERA duty disability, officers are not obligated to notify the Police Department that an application was submitted. Meuser said the city isn’t being transparent about departures, and the numbers it sees will lag as PERA benefits take months to process.


Alaska Supreme Court justices call for system improvements

The justices of the Alaska Supreme Court have called for improvements within the judicial system to ensure equitable and fair treatment for people of color. The four justices posted a letter online Friday saying there needs to be systematic improvements for African Americans, Alaska Natives and other groups.

The letter is addressed to “Fellow Alaskans” and signed by Chief Justice Joel Bolger and Justices Daniel Winfree, Peter Maassen and Susan Carney. Justice Craig Stowers retired June 1, and his seat has not yet been filled.

The justices referred to the ongoing social unrest sparked by the police killing of George Floyd in Minnesota. Floyd, 46, a black man, died May 25 after a white Minneapolis police officer pressed his knee on Floyd’s neck for nearly nine minutes while he was handcuffed and lying on the ground. His death prompted protests across the U.S. and around the world against police brutality and racial injustice.

“As we watch events unfolding in the aftermath of the death of George Floyd, we are saddened to see again that the ideals on which our society is founded are far from the reality of many people’s lives,” the letter said.

The justices said they must “provide an accessible and impartial forum” for cases. “We recognize that too often African-Americans, Alaska Natives, and other people of color are not treated with the same dignity and respect as white members of our communities," the justices wrote. “And we recognize that as community members, lawyers, and especially as judicial officers, we must do more to change this reality.”

They wrote that there needs to be a continued effort to make the court system “reflect the community that we serve." The justices said they would continue to work with the court's advisory Fairness and Access Commission and outreach programs such as The Color of Justice.


Pandemic means a silent June at the Supreme Court

It’s the time of the year when Supreme Court justices can get testy. They might have to find a new way to show it.

The court’s most fought-over decisions in its most consequential cases often come in June, with dueling majority and dissenting opinions. But when a justice is truly steamed to be on a decision’s losing side, the strongest form of protest is reading a summary of the dissent aloud in court. Dissenting justices exercise what a pair of scholars call the “nuclear option” just a handful of times a year, but when they do, they signal that behind the scenes, there’s frustration and even anger.

The coronavirus pandemic has kept the justices from their courtroom since March and forced them to change their ways in many respects. Now, in their season of weighty decisions, instead of the drama that can accompany the announcement of a majority decision and its biting dissent, the court’s opinions are being posted online without an opportunity for the justices to be heard.

University of Maryland, Baltimore County political science professor William Blake, who co-authored the article calling oral dissents the nuclear option, says a June without them would be a “missed opportunity.” They are “a chance to see the justices as exhibiting emotions,” not just the logic of their opinions, he said.


Big Oil loses appeal, climate suits go to California courts

Big Oil lost a pair of court battles Tuesday that could lead to trials in lawsuits by California cities and counties seeking damages for the impact of climate change.

The 9th U.S. Circuit Court of Appeals rejected arguments by energy companies and ruled state courts are the proper forum for lawsuits alleging producers promoted petroleum as environmentally responsible when they knew it was contributing to drought, wildfires, and sea level rise associated with global warming.

The lawsuits claim Chevron, Exxon Mobil, ConocoPhillips, BP, Royal Dutch Shell and other companies created a public nuisance and should pay for damage from climate change and help build sea walls and other infrastructure to protect against future impact construction that could cost tens of billions of dollars.

The ruling overturned a decision by one federal judge, who had tossed out lawsuits brought by the cities of San Francisco and Oakland.

“It is time for these companies to pay their fair share,” San Francisco City Attorney Dennis Herrera said in a statement applauding the ruling. “They should not be able to stick taxpayers with the bill for the damage they knew they were causing. We will continue to hold these companies accountable for their decades-long campaign of public deception about climate change and its consequences.”

While the rulings were victories for the coastal counties and cities all in the San Francisco Bay Area except for the tiny city of Imperial Beach in San Diego County and cheered by environmental groups, it could take years before they ever get to a jury, if they make it that far.


Virus whistleblower tells lawmakers US lacks vaccine plan

Whistleblower Dr. Rick Bright warned on Thursday that the U.S. lacks a plan to produce and fairly distribute a coronavirus vaccine when it becomes available. The nation could face “the darkest winter in modern history” unless leaders act decisively, he told a congressional panel.

Bright alleges he was ousted from a high-level scientific post after warning the Trump administration to prepare for the pandemic.

Testifying Thursday, Bright said, “We don’t have (a vaccine plan) yet, and it is a significant concern.” Asked if lawmakers should be worried, Bright responded, “absolutely.”

Bright, a vaccine expert who led a biodefense agency in the Department of Health and Human Services, said the country needs a plan to establish a supply chain for producing tens of millions of doses of a vaccine, and then allocating and distributing them fairly. He said experience so far with an antiviral drug that has been found to benefit COVID-19 patients has not given him much confidence about distribution. Hospital pharmacies have reported problems getting limited supplies.

The White House has begun what it calls “Operation Warp Speed” to quickly produce, distribute and administer a vaccine once it becomes available.

Bright testified Thursday before the House Energy and Commerce Committee. Aspects of his complaint about early administration handling of the crisis were expected to be backed up by testimony from an executive of a company that manufactures respirator masks.
