Court won’t stop Texas abortion ban, but lets clinics sue

The Supreme Court on Friday left in place Texas’ ban on most abortions, offering only a glimmer of daylight for clinics in the state to challenge the nation’s most restrictive abortion law.
The decision, little more than a week after the court signaled it would roll back abortion rights and possibly overturn its landmark Roe v. Wade decision, was greeted with dismay by abortion rights supporters but praise by opponents.
Five conservative justices, including three appointed by former President Donald Trump, formed a majority to limit who can be sued by the clinics, a result that both sides said probably will prevent federal courts from effectively blocking the law.
Texas licensing officials may be sued, but not state court judges, court clerks or state Attorney General Ken Paxton, the court ruled. That seems to leave people free, under the unusual structure of the Texas law, to sue abortion clinics and anyone else who “aids or abets” an abortion performed after cardiac activity is detected in an embryo, around six weeks and before some women know they’re pregnant.
“The Supreme Court has essentially greenlit Texas’s cynical scheme and prevented federal courts from blocking an unconstitutional law,” the Center for Reproductive Rights, which represents the Texas clinics, said on Twitter.
The court acted more than a month after hearing arguments over the law, which makes no exceptions for rape or incest.

Italy frees man convicted of 2007 murder of Meredith Kercher

The only person convicted in the 2007 murder of British student Meredith Kercher was freed Tuesday after serving most of his 16-year prison sentence, his lawyer said.
Attorney Fabrizio Ballarini said Rudy Guede’s planned Jan. 4 release had been moved up a few weeks by a judge and he was freed on Tuesday. He will continue to work in the library at the Viterbo-based Center for Criminology Studies, Ballarini said in an email.
Guede had already been granted permission to leave prison during the day to work at the center while he served his sentence for the 2007 murder of 21-year-old Kercher.
The case in the university city of Perugia gained international notoriety after Kercher’s American roommate, Amanda Knox, and Knox’s then-boyfriend were placed under suspicion. Both were initially convicted, but Italy’s highest court threw out the convictions in 2015 after a series of flip-flop decisions.
Guede was originally convicted in a fast-track trial procedure. He has denied killing Kercher.

International Criminal Court to probe abuses in Venezuela

The International Criminal Court is opening a formal investigation into allegations of torture and extrajudicial killings committed by Venezuelan security forces under President Nicolás Maduro’s rule, the first time a country in Latin America is facing scrutiny for possible crimes against humanity from the court.
The opening of the probe was announced Wednesday by ICC Chief Prosecutor Karim Khan at the end of a three-day trip to Caracas.
Standing alongside Maduro, Khan said he was aware of the political “fault lines” and “geopolitical divisions” that exist in Venezuela. But he said his job was to uphold the principles of legality and the rule of law, not settle scores.
“I ask everybody now, as we move forward to this new stage, to give my office the space to do its work,” he said. “I will take a dim view of any efforts to politicize the independent work of my office.”
While Khan didn’t outline the scope of the ICC’s investigation, it follows a lengthy preliminary probe started in February 2018 — later backed by Canada and five Latin American governments opposed to Maduro — that focused on allegations of excessive force, arbitrary detention and torture by security forces during a crackdown on antigovernment protests in 2017.
Human rights groups and the U.S.-backed opposition immediately celebrated the decision. Since its creation two decades ago, the ICC has mostly focused on atrocities committed in Africa.
“This is a turning point,” said Jose Miguel Vivanco, the Americas director for Human Rights Watch. “Not only does it provide hope to the many victims of Maduro’s government but it also is a reality check that Maduro himself could be held accountable for crimes committed by his security forces and others with total impunity in the name of the Bolivarian revolution.”
It could be years before any criminal charges are presented as part of the ICC’s investigation.
Maduro said he disagreed with Khan’s criteria in choosing to open the probe. But he expressed optimism that a three-page “letter of understanding” he signed with the prosecutor that would allow Venezuelan authorities to carry out their own proceedings in search of justice, something allowed under the Rome statute that created the ICC.

Minnesota Supreme Court defers ruling on Minneapolis police

The Minnesota Supreme Court issued a narrow ruling Thursday in the fight over a ballot question about the future of policing in Minneapolis, but it didn’t settle the bigger question of whether the public will get to vote on the issue.
Chief Justice Lorie Gildea’s ruling lifted a small part of a lower court’s order that rejected the ballot language approved by the City Council, saying that elections officials don’t have to include notes with ballots instructing people not to vote on the question and that any votes won’t be counted.
The order didn’t address the main issue in dispute — whether voters will get to decide on a proposed charter amendment that would replace the Minneapolis Police Department with a new Department of Public Safety that “could include” police officers “if necessary.”
The proposal has its roots in the “defund the police” movement that gained steam after the death of George Floyd in Minneapolis police custody last summer, but it leaves critical details about the new agency to be determined later.
The Supreme Court was under pressure to rule quickly because early and absentee voting opens Friday in the Minneapolis municipal elections, and ballots have already been printed.
Terrance Moore, an attorney for the Yes 4 Minneapolis campaign, which spearheaded the proposal, said he expects a ruling on the bigger question to come at some point later. The city attorney’s office agreed that the high court has yet to rule on the main issues.
Joe Anthony, an attorney for former City Council member Don Samuels and two other people who challenged the ballot language as misleading, called the order “a little mysterious.” He noted the lower court injunction barring counting and reporting votes was left in place, at least for the moment. There are a few possibilities for what could happen next, he said, including the Supreme Court taking time for fuller arguments, then deciding by Nov. 2 whether the votes cast would count.

Judge tells prison to seize Nassar’s money for victims

A judge ordered the government to take money from the prison account of a former Michigan sports doctor who owes about $58,000 to victims of his child pornography crimes.
Larry Nassar has received about $13,000 in deposits since 2018, including $2,000 in federal stimulus checks, but has paid only $300 toward court-ordered financial penalties and nothing to his victims, prosecutors said.
He had a prison account balance of $2,041 in July.
“Because (Nassar) has received substantial non-exempt funds in his inmate trust account since incarceration, he was required by law to notify the court and the United States attorney and to apply those funds to the restitution that he still owed,” U.S. District Judge Janet Neff said Thursday.
In a court filing, Nassar said he had received “gifts” from “third parties.”
He said inmates should be paid a “living wage” for prison jobs so they can “make reasonable payments towards restitution.”
Nassar was a doctor at Michigan State University and USA Gymnastics, which trains Olympians. He pleaded guilty in federal court to child pornography crimes before pleading guilty in state court to sexually assaulting female gymnasts.
Nassar is serving decades in prison.
